1. Introduction and Acceptance

By accessing or using PeacockMusic Library services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use our services.

These terms constitute a legally binding agreement between you and PeacockMusic Library. Your continued use of our services constitutes ongoing acceptance of these terms and any modifications we may make.

3. Definitions

  • “Service” means the PeacockMusic Library website and all related services
  • “Musical Works” means all music tracks available in our catalog
  • “License” means the non-exclusive right to use Musical Works according to purchased terms
  • “You/User” means any individual or entity using our Service
  • “Content ID” means automated copyright detection systems used by platforms like YouTube
  • “Free Music” means tracks designated for no-cost download with usage restrictions

4. Services Offered

4.1 Licensing Services We provide three types of paid licenses for our Musical Works:

  • Basic License ($9.99): Personal projects, YouTube monetization, social media, website background music, Music on Hold
  • Standard License ($29.99): All Basic uses plus commercial projects, paid online advertising, video games, DVD, audiobooks, public performances
  • Premium License ($199.99): All Standard uses plus TV broadcast, radio, streaming platforms (VOD, Film, etc.)


4.2 Free Music Service
Selected tracks available for download at no cost, subject to specific usage restrictions outlined in Section 6.

4.3 Preview Service Ability to preview all Musical Works before purchase.

5. License Terms and Usage Rights

5.1 General License Provisions

  • All licenses are non-exclusive and perpetual
  • Licenses cannot be transferred to third parties
  • Usage must comply with the specific license type purchased

 

5.2 Rights Granted Upon payment, you receive:

  • Mechanical reproduction rights
  • Synchronization rights for audio-visual works
  • Right to modify tracks for your projects (editing, looping, etc.)

 

5.3 Rights Reserved

  • We retain all copyright ownership
  • You cannot claim ownership of Musical Works
  • You cannot register our tracks with Content ID or similar systems
  • You cannot create derivative musical works for redistribution

6. Free Music Terms

6.1 Usage Permissions Free Music may be used for:

  • Personal, non-commercial projects only
  • Online/internet distribution only
  • Educational projects (non-commercial)

 

6.2 Usage Restrictions Free Music cannot be used for:

  • Commercial projects of any kind
  • TV or radio broadcast
  • Paid advertising
  • Public performances (venues, events)
  • Monetized content (without accepting Content ID claims)

 

6.3 Attribution Requirements All Free Music usage requires clear attribution: “Music by PeacockMusic – peacockmusic.com”

 

6.4 Content ID Notice Free Music is registered in Content ID systems. You may receive copyright claims on platforms like YouTube. These claims do not negatively affect your content but may prevent monetization.

7. Account Terms

7.1 Account Creation

  • You must provide accurate, current information
  • You are responsible for maintaining account security
  • One account per person/entity
  • You must be at least 18 years old or have parental consent

 

7.2 Account Termination We may suspend or terminate accounts for:

  • Violation of these terms
  • Fraudulent activity
  • Misuse of our services
  • Non-payment of fees

8. Payment and Billing

8.1 Payment Processing

  • Payments processed through secure third-party systems
  • We accept major credit cards and electronic payments
  • All prices in USD unless otherwise specified
  • Prices subject to change with notice

 

8.2 Billing and Invoices

  • Payment required before license activation
  • Digital invoices sent within 7 business days
  • All sales are final upon delivery

 

8.3 Failed Payments If payment fails, your order will be cancelled. We are not responsible for delivery delays due to payment issues.

9. Refund and Return Policy

9.1 No Refunds Policy Digital products cannot be returned once delivered. All sales are final.

9.2 Technical Issues If you experience technical problems downloading purchased content, contact us immediately. 

9.3 European Consumer Rights EU consumers may have additional rights under local law, but these do not extend to digital content once delivery has begun with consent.

10. Intellectual Property and Copyright

10.1 Our Rights

  • We own all rights to Musical Works in our catalog
  • Our composer Milosz Pawski (BMI IPI: 367859696) holds publishing rights
  • Service content, design, and functionality are protected by copyright

 

10.2 Content ID and PRO Information

  • Our music is registered with BMI and Content ID systems
  • For TV/radio broadcast, provide composer information for PRO reporting
  • Content ID claims are normal and expected for unlicensed usage

 

10.3 Copyright Infringement Unauthorized use of our Musical Works may result in:

  • Legal action for copyright infringement
  • Monetary damages
  • Account termination

11. Privacy and Data Protection

11.1 Data Collection We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR.

11.2 Data Usage Your data is used for:

  • Order processing and delivery
  • Customer support
  • Legal compliance
  • Service improvement (with consent)

 

11.3 Data Rights You have rights to access, correct, delete, or port your personal data. Contact us to exercise these rights.

12. Complaints and Dispute Resolution

12.1 Complaint Process

  • EU consumers may access online dispute resolution platforms

13. Limitations of Liability

13.1 Service Availability

  • Service provided “as is” without warranties
  • We do not guarantee uninterrupted access
  • Maintenance periods may cause temporary unavailability

 

13.2 Liability Limits Our total liability is limited to:

  • The amount you paid for the specific product in question, or

 

13.3 Excluded Damages We are not liable for:

  • Indirect, consequential, or punitive damages
  • Lost profits or business opportunities
  • Data loss not caused by our negligence
  • Third-party service failures

14. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, or other force majeure events.

15. Modification of Terms

15.1 Updates We may modify these terms at any time. Material changes will be announced with at least 30 days notice.

15.2 Acceptance Continued use after changes constitutes acceptance of new terms. If you disagree with changes, discontinue use of our services.

16. Termination

16.1 By You You may terminate your account at any time by discontinuing use. Paid licenses remain valid after account closure.

16.2 By Us We may terminate accounts for terms violations with immediate effect. Termination does not affect existing license rights for compliant usage.

17. General Provisions

17.1 Governing Law These terms are governed by Polish law, without regard to conflict of law principles.

17.2 Severability If any provision is found unenforceable, the remainder of these terms remains in effect.

17.3 Entire Agreement These terms constitute the entire agreement between parties, superseding all prior agreements.

17.4 No Waiver Failure to enforce any provision does not constitute a waiver of that provision.
